These Terms of Service (“Terms”) describe your rights and responsibilities when using the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy.

The Python Pants are intended for general wellness and muscle recovery use by healthy, active individuals. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Consult a healthcare professional before use if you have an existing medical condition.

 

Section 1 – Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your province or state of residence. You are solely responsible for the security of your account credentials and all account activity. You may not transfer, sell, assign, or license your account to any other person.

 

Section 2 – Our Products

We have made every effort to accurately represent our products. Colours or product appearance may differ from how they appear on your screen. We do not warrant that the quality of products purchased will meet your expectations. All product descriptions are subject to change at our sole discretion.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Strivonix reserves the right to accept or decline any order. Your order is not accepted until Strivonix confirms acceptance and receives payment. Please review your order carefully before submitting — cancellations may not be accommodated after acceptance. Your purchases are subject to our Refund Policy.

 

Section 4 – Prices and Billing

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Posted prices do not include taxes, shipping, handling, customs, or import charges unless otherwise stated. You agree to provide accurate payment information and to pay all applicable charges.

 

Section 5 – Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Our Services and all content therein are owned by Strivonix, its affiliates or licensors, and are protected by Canadian and foreign intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved by Strivonix.

 

Section 7 – Optional Tools

You may be provided access to third-party tools through the Services, which we neither monitor nor control. Such tools are provided “as is” without any warranties. We shall have no liability arising from your use of optional third-party tools.

Strivonix is powered by Shopify. All sales and purchases in our store are made directly with Strivonix. Shopify is not responsible for any aspect of sales between you and Strivonix. You hereby release Shopify and its affiliates from all claims arising from your transactions with Strivonix.

All personal information collected through the Services is subject to our Privacy Policy and governed by PIPEDA and applicable Canadian privacy legislation. Certain personal information may also be subject to Shopify’s Privacy Policy.

We reserve the right to correct any errors, inaccuracies, or omissions in pricing, product descriptions, or availability at any time without prior notice, including after an order has been submitted.

EXCEPT AS EXPRESSLY STATED BY STRIVONIX, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

 

Section 16 – Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, STRIVONIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

 

Section 17 – Indemnification

You agree to indemnify, defend, and hold harmless Strivonix, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims arising out of your breach of these Terms, your violation of any law or rights of a third party, or your access to and use of the Services.

 

Section 18 – Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

 

Section 19 – Waiver; Entire Agreement

Our failure to exercise any right or provision shall not constitute a waiver. These Terms, together with our Privacy Policy and applicable policies posted on our site, constitute the entire agreement between you and Strivonix regarding the Services.

 

Section 20 – Assignment

You may not transfer or assign these Terms without our prior written consent. We may transfer or assign these Terms without notice to you.

 

Section 21 – Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. You and Strivonix consent to the exclusive jurisdiction of the courts of Ontario and the federal courts of Canada for any disputes not subject to arbitration.

 

Section 22 – Dispute Resolution

Disputes arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation within thirty (30) days of written notice. If unresolved, disputes will be submitted to binding arbitration under the rules of the ADR Institute of Canada (ADRIC), with arbitration conducted in Kitchener, Ontario.

 

Section 23 – Headings

Headings in these Terms are for convenience only and shall not affect interpretation.

 

Section 24 – Changes to Terms of Service

We reserve the right to update these Terms at any time by posting changes to our website. Your continued use of the Services following any changes constitutes acceptance. We will notify you of material changes as required by applicable law.
